Terms of service
The deal, in plain words.
Effective October 8, 2026.
Who we are
ShoutOrbit is run by Profound AI Solutions LLC, a company registered in Delaware, USA. These terms are an agreement between you and us. By creating an account, opening an Orbit, or placing a bid, you accept them.
You must be 18 or older to use ShoutOrbit.
What ShoutOrbit is
A creator opens an Orbit for something they are about to make and writes a promise — for example, "I'll name the top three on Friday." Sponsors bid for the few slots the creator will actually perform. Bidding is free. Once bidding ends, the creator has up to 2 days to check the winners; then the winners are charged their bid, nobody else is charged anything, and the creator is paid after they publish.
ShoutOrbit is the marketplace and the payment rail. The promise is the creator's. We do not make, edit, or approve their content.
If you are a creator
You keep 80% of every winning bid. On payments under $5, you keep 70%, because small charges cost more to process. The rest is our fee.
You are paid 7 days after you paste the link to the published content. During those 7 days a sponsor in a slot can tell us your content did not do what your Orbit promised, and your payout waits until we have looked.
The link must be on a channel you declared before the Orbit opened, and the content must do what your promise said. For a YouTube video or a Twitch past broadcast, you must also say when the shout-out starts. If you do not publish within 7 days of the date you set, every sponsor is refunded in full and you are not paid.
After bidding ends you have up to 2 days to check your winners. Anyone you don't remove is charged automatically when those 2 days end, or sooner if you charge them yourself.
You can reject any sponsor, including the top bidder, for any reason. A rejected sponsor is not charged, or is refunded in full, at our cost. Until the list is settled, the next bid in line moves up into the place and pays its own bid.
If a sponsor's bank disputes their charge before you have been paid for it, you are not paid that sponsor's share, whatever the bank decides in the end. If a card's bank warns that a charge may be fraud, that sponsor's share waits until we have looked, and if the money goes back to them you are not paid it. Every other sponsor on the Orbit pays out as normal. Money already paid to you is never taken back.
Payouts go through Stripe. Stripe decides whether it can pay you; we follow what Stripe says. You are responsible for your own taxes on what you earn.
If you are a sponsor
Bidding is free. While bidding is open, your bid shows on the Orbit: your handle, your pitch, and your link. When bidding ends, only the bids in a slot or picked by the creator stay on the Orbit. If you paid a listing fee before October 8, 2026, that listing stays on its Orbit.
When you bid, you save a card, or for a bid above $300 a US bank account, with Stripe. Nothing is held on it. You tick a box that says how much you will be charged if you win and until when you can cancel, and that tick is your approval. If you win, we charge that amount once, within 4 days after bidding ends. You win if you are in a slot when bidding ends, if you move up when a winner drops out, or if the creator picks your pitch (unless you told us not to let them). If you do not win, you are charged nothing.
You can cancel a bid until 12 hours before bidding ends. After that, and once you are charged, your bid is final until the content is published; then you can refund it for 7 days. Bids and raises are still allowed in the last 12 hours, and they are final as soon as they are placed. If something goes wrong after you are charged and before the content is published, use "Ask for a refund" on your receipt and a person will sort it out.
After bidding ends the creator has up to 2 days to check the winners and may remove any of them; the winners they keep are charged then. The three bids below the winners are next in line: if a winner drops out or does not pay, the first of them moves up and is charged their own bid. If you are next in line, you can step out for free until nobody can move up any more.
If your payment fails, you have 1 day to fix it from the link we email you. A winning bid still unpaid after that is released, the next in line takes its place, and you get a strike: the first is a warning, a second within 6 months stops you bidding for a week, and a third for a year. The card or bank account the unpaid bid was on is barred from bidding with you. A payment that failed for a reason that was not yours, or a failure we did not tell you about in time, is never a strike.
A bid above $300 is paid from a US bank account, up to $2,000 a bid. Saving the account authorises us to debit it once for each bid of yours that wins, for the amount you agreed; a bank payment takes about 4 business days to clear. Until one payment from a bank account has gone through, that account can cover at most $500 of your open bids. Sponsors outside the US cannot bid above $300.
A slot is a promise that the creator will do what their Orbit said. It is not a guarantee of results, sales, or any particular wording. If you have a slot, you have 7 days once the creator publishes — the same 7 days before the creator is paid — to tell us the promise was not kept; that pauses the creator's payout while we look. When the creator publishes, we email you to ask whether you were in it, and answering no is one way to tell us. Not answering is not a complaint.
Your pitch may not contain links (put the link in the link field), slurs, harassment, or anything the creator has blocked. We check every pitch and link before it appears. Link shorteners are refused.
If you post a contract
Posting a contract is free. When you post one, we place a hold on your card for its budget. The contract is public on the contracts board for 3 days, and creators can send you requests.
If you pick a creator, your hold becomes a shout-out in their video: it is charged after they accept, the sponsor terms above apply to it, and the creator is paid 7 days after they publish. If they never publish, you are refunded in full.
If you pick nobody within 3 days, or you withdraw the contract, the hold is released and nothing is charged. We may take a contract off the board, and if we do, the hold is released and we tell you why.
Once you pick a creator, the two of you can talk in a chat on ShoutOrbit. Chats are checked for contact sharing. Sharing phone numbers, emails or social handles can get your account banned for up to 6 months. Deals made outside ShoutOrbit aren't protected. Chats are read by an automated check for contact sharing, and a person reviews anything it flags before anything happens: the first time is a warning, and doing it again can get your account suspended for up to 6 months. A suspension never takes away money owed to the other person.
Messages between creators and sponsors
A creator can message the sponsor of any bid on their Orbit, and the sponsor can reply. Messages stay on ShoutOrbit, and the deal stays on ShoutOrbit with them: that is what keeps a sponsor's refund and a creator's payout protected.
Do not share contact details in a message. That means phone numbers, email addresses, social media handles, messaging app usernames, and links or any other way to reach you outside ShoutOrbit — and asking for them counts too.
Sharing contact details can get the payment accounts of both people in the conversation banned — the creator's and the sponsor's. A banned creator is not paid and cannot open Orbits; a banned sponsor cannot bid or be charged. A ban never takes away money already owed to the other person.
A creator may not ask a sponsor to raise their bid. How much to bid is the sponsor's decision alone.
If the other person shares contact details or asks for yours, press Report under their message. A person at ShoutOrbit reviews every report before anything happens.
What can't be sold here
No Orbit, bid, pitch, link, or published content paid for through ShoutOrbit may involve any of these:
Adult content or services — nudity, sexually explicit material, or adult live chat.
Infringing someone else's intellectual property — their copyright, trademark, or other rights, including leaked or pirated music, video, software, or writing.
Violent extremism or hate — content that engages in, encourages, promotes, or celebrates unlawful violence, or attacks any group for their race, religion, disability, gender, sexual orientation, national origin, or any other characteristic they cannot change.
We remove anything that breaks this rule. A bid we remove is not charged, or is refunded in full.
We keep track of what we remove. The first time is usually a warning; doing it again can get your account suspended for up to a year, or closed. Content involving the sexual exploitation of children, violent extremism, or anything illegal closes the account the first time.
Anyone can report content that breaks this rule — a viewer, a sponsor, or the owner of a copyright or trademark — with the "Report this Orbit" link on any Orbit, or by writing to support@shoutorbit.com. Say which Orbit and which pitch. A person reviews every report, and we remove what breaks the rule.
Money
All amounts are in US dollars unless the Orbit says otherwise. Payments are processed by Stripe; we never see or store your card number. Stripe's own terms apply to the payment.
We are not a bank and do not hold balances for you. A saved card or bank account is charged only for a winning bid, for the amount you agreed, and nothing is held on it before then. Older bids that put a pending hold on the card, and contract budgets, are still held on the card as an authorization until they are charged or released.
We never contest a dispute. If a sponsor's bank asks us about a charge before opening a dispute, we answer by refunding it in full wherever Stripe allows it. Once a dispute is open the bank settles it, and we cannot refund that charge separately while it is. If the bank that issued a card warns us a charge on it may be fraud, we may refund that charge in full, and its bid comes off the Orbit. A bank's request for proof that a bank debit was authorised is answered with your authorisation, not a refund. A pattern of disputes or refund abuse may close an account.
Your account
Your handle is your link — shoutorbit.com/yourname. It is yours while your account is open. You can change it once every 30 days; old links stop working. Some words are reserved.
Keep your sign-in code to yourself. Anything done from your account is yours.
We may suspend an account that breaks these terms, harms other users, or is used for fraud. A suspended account cannot sign in. A suspended creator's Orbits stop taking bids, and nothing is paid out to them while the suspension lasts. Sponsors on an Orbit the creator had not published get their money back 7 days after its publish date: a hold is released, a charge is refunded in full, and a bank payment still in progress is stopped, or refunded when it lands.
What we are not responsible for
ShoutOrbit is provided as is. We do not promise it will always be available or error-free. We are not responsible for what creators publish, whether sponsors get the outcome they hoped for, or for platforms like YouTube, Instagram, or TikTok changing their rules.
Our total liability to you for anything arising from ShoutOrbit is limited to the fees you paid us in the 12 months before the claim.
Changes and disputes
We may update these terms. If a change matters, we will tell you by email before it takes effect. Continuing to use ShoutOrbit after that means you accept the new terms.
These terms are governed by the laws of Delaware, USA. If we have a disagreement, write to us first — most things are settled in one email.
